피고인은 2018. 10. 11. 01:30경 서울 송파구 B 앞 노상에서 그 곳을 걸어가던 피해자 C(가명, 여)를 발견하고 강간하기로 마음먹고, 그녀를 뒤따라가 피해자에게 ‘쉿’이라고 하여 이에 놀라 도망가는 피해자의 팔과 목을 붙잡고 인근 주차장 안으로 끌고 가다가 피해자가 반항하면서 도망치려고 하자 다시 피해자의 목덜미를 붙잡아 목을 조르면서 발버둥치는 피해자를 인근 주차장으로 끌고 간 다음 손으로 피해자의 가슴을 만지면서 점퍼를 벗기려고 하는 등 피해자를 강간하려다가 피해자가 도망가는 바람에 그 뜻을 이루지 못하고 미수에 그쳤다.
