The judgment below is reversed, and the case is remanded to the Patent Court.

1. As to the ground of appeal on interpretation of claims

A. Although the scope of protection of a patented invention is determined by the descriptions of the claims and it is not, in principle, permissible to limit or expand the scope of protection by an explanation or drawing of the invention. However, the technical meaning of the claims can be accurately understood by taking into account the description or drawing of the invention. As such, the interpretation of the matters described in the claims should be based on the general meaning of the text, but should be objectively and rationally after considering the technical significance of the invention to express by the text in consideration of the description or drawing of the invention, etc.
