A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Notwithstanding the fact that the Defendant and D’s non-pharmaceutical pharmacist or herb pharmacist cannot establish a pharmacy, the Defendant established and operated the said F pharmacy in the name of D and D from October 12, 2006 to October 14, 2014, with the “F pharmacy” located in Dongdaemun-gu Seoul, Dongdaemun-gu, Seoul, to pay the Defendant KRW 1 million or KRW 1.5 million per month to the above D’s private person.

Accordingly, the defendant, in collusion with D, established a pharmacy even though he is not a pharmacist or herb pharmacist.

2. 피고인과 G의 비약 사의 의약품 조제 약사 또는 한약사가 아니면 의약품을 조제할 수 없음에도 불구하고, 피고인은 2014. 10. 13. 경 위 F 약국에서 당귀, 천궁 등 15개 한약 재료를 임의로 섞고, G은 같은 달 14. 경 서울 동대문구 H에 있는 그가 운영하는 ‘I ’에서 위 재료를 가루로 빻고 꿀을 넣어 환으로 만들며, 피고 인은 위 환에 경면 주사를 입힌 후 낱개 포장하는 방식으로 약 9,950g 의 우황 청심환을 조제하였다.

Accordingly, the defendant conspireds with G to prepare medicines even though he is not a pharmacist or herb pharmacist.

3. Although the Defendant’s non-pharmaceutical drug sales pharmacy founder and the Defendant could not sell the drugs, the Defendant sold approximately KRW 10,00 boxes per 1 salary paper to customers who found the place at the time and place specified in paragraph 1, approximately KRW 25,00 per month, for about KRW 5,00 per 1 salary paper, for about KRW 10 per 10,00 per 1 salary paper for fire extinguishing agents.

Accordingly, the Defendant sold medicines even though he was not a pharmacy founder.
