Defendant
A Imprisonment for eight months, Defendant B shall be punished by a fine of 2,00,000 won, and Defendant C shall be punished by a fine of 1,50,000 won.
Reasons
Punishment of the crime
Defendant A is a pharmacist who operates 'E pharmacy' in Thai City D, and Defendant B is a person who is not a pharmacist as his/her wife.
No person, other than pharmacists or herb pharmacists, shall prepare drugs, and pharmacists or herb pharmacists shall prepare drugs within the scope of licenses, respectively.
Nevertheless, in the event that Defendant A, a pharmacist, is absent from his pharmacy, the Defendants conspired to prepare medicines at will by receiving a prescription from the patients.
Accordingly, on September 24, 2014, Defendant A entered the above pharmacy in a hospital, and instructed Defendant B to prepare medicines by obtaining a prescription from the patient. Defendant B, in response to this, received a prescription from the patient F, who visited the pharmacy from the patient without the defendant, and arbitrarily prepared medicines from April 27, 2017, after receiving 6,390 won from the patient F, who visited the pharmacy from the patient without the defendant, and received 6,451,57 won in total, as shown in the attached list of crimes, from around April 27, 2017.
Accordingly, the Defendants conspired to prepare medicines by a person other than a pharmacist.
Defendant A, “2018 Highest 255,” is a pharmacist who operates a pharmacy under the trade name of “E pharmacy” in Thai City D, and Defendant B is a wife of Defendant A, and Defendant C is a person who is an employee of the above pharmacy without having a pharmacist’s license and both Defendant B and Defendant C is an employee of the above pharmacy.
1. No person, other than Defendant B, Defendant C pharmacist, or herb pharmacist, shall prepare medicines; and pharmacists or herb pharmacists shall prepare medicines within the limit of license;
Nevertheless, the Defendants: (a) from January 8, 2018 to January 16:50 of the same day, among the absence of a private person A, and (b) Defendant B, upon receiving a prescription from the customer G visiting the pharmacy, prepared drugs in accordance with the prescription to Defendant C.
