A defendant shall be punished by imprisonment with prison labor for not more than ten months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Following the sinking of the Sewol ferry on January 6, 2015, in cases where cargo vehicles are loaded on a passenger ship in accordance with the Shipping Act and the Enforcement Rule of the Shipping Act as amended, the client shall submit a measurement certificate issued by the person who registered the measurement certification business to the port passenger transport business operator, and the system was modeled on November 20, 2014.
However, as the loading of cargo after the measurement has been caused by driving away at the time of departure of passenger ships, the Defendant forged the measurement certificate and submitted it to an ocean-going passenger transport business operator, thereby attempting to load the cargo without taking measurements.
2. On February 13, 2017, the Defendant forged private document: (a) made one copy of a measurement certificate in the name of E measurement company by stating that “1”, “2017-02-13”, “D”, “W”, “830km in the vehicle column,” and “26,830km” in the vehicle column; and (b) affixing the seal of the name of E measurement company, the representative of E measurement company affixed the seal of F, and making one copy of the measurement certificate in the name of E.
Accordingly, the Defendant, for the purpose of uttering, forged a measurement certificate in the name of E metrology, which is a private document on proof of facts, and forged a measurement certificate in the same manner six times from February 13, 2017 to March 20, 2017, such as the list of crimes No. 1.
3. On February 13, 2017, at the fourth wharf of Jeju-si 191, the Defendant at the time of the instant investigation document: (a) submitted and used the forged measurement certificate as described in paragraph (2) to employees of G, a coastal passenger transport business entity, who are not aware of the forgery on February 13, 2017, as if it were a document duly formed, and (b) was forged by the same method six times in total from February 13, 2017 to March 20, 2017, as described in paragraph (2) of the attached Table of Crimes.
