Punishment of the crime

[criminal record] On October 13, 2011, the Defendant was sentenced to eight months of imprisonment with prison labor at night in the Gangnam Branch of the Chuncheon District Court due to the night building intrusion, larceny, etc., and the detention was revoked on January 25, 2012 during the execution of the sentence, and the above judgment became final and conclusive on February 21, 2012.

【Criminal Facts】

1. Larceny;

A. On June 21, 2014, at around 06:00, the Defendant: (a) cut off the victim E with cash of KRW 30,00,00,000, 1SK Card (F), and the market price unsatisfed with identification cards attached thereto.

B. On June 25, 2014, at around 14:10 on June 25, 2014, the Defendant: (a) cut off the victim H’s physical card of the National Bank in the name of the victim (I); (b) one passbook of the National Bank (J); (c) one passbook of the credit union (K); and (d) one resident registration certificate.

2. Fraud and violation of the Specialized Credit Finance Business Act;

A. On June 25, 2014, the Defendant presented the H’s physical fitness card as if it were his/her card, as set forth in paragraph 1(b), at the N convenience store in the operation of the victim M in Gangseo-si L around 14:34 on June 25, 2014, and settled the payment by purchasing one cigarette equivalent to KRW 2,100 at the market price from the victim.

The Defendant used a stolen debit card at the same time and place as above, and by deceiving the victim as above, received the above goods from the victim.

B. On June 25, 2014, around 14:53, the Defendant presented the H’s physical fitness card, which was stolen, as in paragraph 1(b), from the bank of the victim’s P, located in Gangnam-si (O), as if the Defendant was his/her card, and settled the account by purchasing one 14k bbb from the victim, equivalent to KRW 140,000 at the market price.

The Defendant used a stolen debit card at the same time and place as above, and received the said goods from the victim by deceiving the victim.

3. The Defendant who attempted to commit fraud shall have jurisdiction over 06:51 on June 21, 2014.
