A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[2020 Godan59] On November 26, 2019, the Defendant asked the victim I who reported and contacted the above writing that “on the transfer of the price of the goods, he will send a foundation for the formation of a foundation for the company.”
However, the defendant did not have a foundation for the sale of goods, and there was no intention or ability to send a foundation for the distribution even if he received the price of goods from the victim.
The Defendant received KRW 33,00 from the victim’s J account in the name of the Defendant on the same day, and received KRW 8,945,500 in total from 71 times to 3 March 3, 2020, as described in the attached Table of Crimes (1) by the foregoing method.
Accordingly, the defendant deceivings the victims and received property from the victims.
[2020 Godan1147] On January 27, 2020, the Defendant reported a notice to the Internet site H at the Defendant’s home of the F apartment G heading in Busan Seo-gu, Busan, on the Internet site, stating that the Defendant would send a powder if he transfers the milk to the victim K with the contact.
However, due to the fact that the defendant did not have the share of goods, even if he receives the share of goods from the victim, he did not have the intention or ability to sell the share of goods.
Nevertheless, the Defendant, by deceiving the victim as above, received KRW 77,00 from the victim to the L bank account under the name of the Defendant on the same day, and received KRW 1,575,500 from the victims on nine occasions from the time until January 30, 2020, such as the list of crimes (2) as shown in the attached Table of Crimes (2).
[2020 Godan1379] Around February 15, 2020, the Defendant posted at the Defendant’s house of the F apartment G head of Busan Seo-gu F apartment G, and at H, at the Kaf, a letter stating that “The sale of IM M M M MM milk.”
