Defendant
A shall be punished by imprisonment with prison labor of four months and fine of one thousand won, and imprisonment with prison labor of ten months and fine of two thousand won.
Reasons
Punishment of the crime
1. Defendant B
A. On July 21, 2016, the Defendant opened a gambling place: (a) heard the fact that H provided gambling places and opened a gambling place by playing the so-called “ware” that causes participants in the gambling; (b) the Defendant: (c) took charge of the role of referring to a “drawing house” by lending gambling money to the participants in gambling and receiving interest; and (d) I took charge of the role of referring to a “drawing house” in the name of a person who will engage in gambling as a gambling place; and (c) I takes charge of the role of referring to a “drawing house” in the name of a person who will engage in gambling as a gambling place.
Thus, from July 21, 2016 to 03:00 on the following day, the Defendant and H et al.: (a) had facilities necessary for gambling, such as lives and fences, in G penta; (b) had approximately 20 gambling participants receive money of KRW 3,000 via the 51 chapter; and (c) had them receive money of KRW 3,00,000 from the 51 chapter; and (d) had the participants take part in the 6th of the floor of the floor in three parts, without any restriction from 30,000 won to the 30th of the floor; and (b) had the participants take part in the 30,000 won and take part in the 3rd of the total number of the 3rd head and take part in the 10% of the profits earned in return.
In addition, the Defendant conspired with H, etc., from that time until August 20, 2016, opened a gambling place for profit-making purposes at least five times in total, as shown in the attached Table 1 list of crimes.
B. On July 21, 2016, from around 22:30 to the next 03:00 on the following day, the Defendant gambling with many gambling participants, including J, and engaged in gambling in the said gambling in the above manner as seen above in the gambling place. From that time, from August 20, 2016, the Defendant gambling in the above way five times in total as shown in the list of crimes in the attached Table 2.
2. Defendant A
A. On August 16, 2016, the Defendant established a gambling place, H in the “L pentol” located in the G in Young-gun, Chungcheongnam-gun, Chungcheongnam-do around H.
