A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
1. On September 10, 2008, the Defendant against the victim K made a false statement to the effect that “A person engaged in a real estate-related business, who is a building company in Bocheon-gu, Bocheon-gu, Bocheon-gu, the Military Mutual Aid Association established a plan to build an apartment in Bocheon-si, and when the site is secured, the Defendant seeks to carry out the apartment project by linking the fund investors. In this regard, the Defendant borrowed the cost necessary. The Defendant would be able to receive several million won, and the said money will be repaid if paid off.”
However, at that time, the Military Mutual Aid Association was not established with a plan to build apartment buildings at the time, and the defendant was not able to receive a million won, and there was no intention or ability to repay the plan even if he borrowed money from the victim due to no special property or income at that time.
As such, the Defendant, by deceiving the victim, received 50,00 won from the victim to the post office account (L) in the name of the Defendant on the same day, and acquired 2,157,000 won in total by the same way 54 times from that time to March 10, 209, as shown in the attached crime list.
2. On March 2, 2009, the Defendant against the victim M made a false statement to the effect that “A building operator who implements construction-related construction-related construction-related construction, is determined by the Military Mutual Aid Association at the time when the site is secured. When the site is secured, the Defendant attempted to implement the apartment project by linking the funds to the fund investors.
