A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

No person of "2017 Highest 3665" shall deliver any access medium in return for receipt, demand or promise of consideration in using and managing the access medium.

1. The Defendant received a proposal that “to pay the consideration for the creation of a corporate passbook from a person in an unsound name,” and accepted it. On April 6, 2017, the Defendant opened the Agricultural Cooperative Fund account in the name of the Nongju-si, Inc., Ltd., and received approximately KRW 100,000 in return, while transferring the passbook and cash card to a person in an unsound name.

Accordingly, the defendant delivered the approaching media while receiving the price.

2. On May 19, 2017, the Defendant: (a) received a proposal from a person under whose name the name the Defendant received the proposal that “to pay the price for the business of creating a corporate passbook; and (b) received it; and (c) opened the National Bank H account and I account in the name of G at the National Bank located in Yong-si around May 19, 2017, respectively; and (d) transferred the passbook, cash card, etc. connected to each account to the name of the party in whose name the account was not opened; and

Accordingly, the defendant delivered each approaching medium while receiving compensation.

Nevertheless, the Defendant, upon receiving a proposal from a person under whose name the Defendant: “I will pay KRW 20,000 to the company head,” and accepted it; on March 13, 2017, the Defendant opened a new cooperation account in the name of J (K) in the Kim Jong-gu, Inc., Ltd., and, on the first floor of the coffee shop where the trade name near the labor union’s station cannot be known, received KRW 80,00 in return for the receipt of the cash card connected to the said account and theOTP card to the non-standing person.

Accordingly, the defendant delivered the approaching media while receiving the price.
