1. The Defendant: (a) KRW 99,240,00 for Plaintiff A; (b) KRW 40,000,000 for Plaintiff C; and (c) KRW 15,000,00 for Plaintiff D, E, and F; and (c) each of them.
Reasons
1. Basic facts
A. On June 23, 1981, investigators, who are affiliated with the defendant for illegal confinement and investigation against the plaintiff A, performing the duties of judicial police officers, were forced to work in the form of voluntary movement without notifying the plaintiff A of the summary of the crime, the reason for arrest, and the right to appoint counsel without the warrant, and without giving the plaintiff A an opportunity to defend himself.
The investigators conducted cruel acts by investigating the Plaintiff A with an illegal confinement for 42 days from August 3, 1981 when the warrant of detention was executed.
B. On August 31, 1981, Plaintiff A was indicted for violation of the Martial Law Act, and the Assembly and Demonstration Act. The main contents of the facts charged are as follows: “To form a clean H with the first order of December 1980 to the first order of May 1, 1981, and on May 27, 1981, the Seoul Criminal Court reversed the Seoul Criminal Court’s imprisonment with prison labor for the Plaintiff on January 22, 1982, and acquitted Plaintiff A of the above facts charged for violation of the Martial Law Act, as the Seoul Criminal Court convicted Plaintiff A of violation of the Martial Law Act. The Seoul Criminal Court reversed the judgment on May 21, 1982 as follows: (a) on May 27, 1981, and (b) on May 27, 1981, which might cause considerable social anxiety; and (c) on May 21, 1987.
(hereinafter “Subject Decision on Review”). The subject decision on review was dismissed on September 14, 1982 by Supreme Court Decision 82Do1847, which became final and conclusive.
3) The Plaintiff A was released on December 24, 1982 upon the sentence sentenced to the sentence and the suspension of the execution of the sentence. C. The Committee on the Settlement of History established under the Framework Act on the Settlement of History for Truth and Reconciliation of Truth and Reconciliation of Truth and Reconciliation of Truth and Reconciliation of Truth and Reconciliation of Truth and Reconciliation (hereinafter referred to as the “Committee on the Settlement of History and Reconciliation”).
