1. Basic facts

A. On November 2008, the Plaintiff and Nonparty E entered into a joint investment agreement (hereinafter “instant agreement”) with Defendant C, who represented by the said Defendant, to jointly purchase 6/7 shares in the F forest, G, G, and H answers, respectively, and to equally distribute profits by conducting a real estate development project (hereinafter “instant agreement”), and jointly sell 1/3 shares, respectively, between the Plaintiff and Nonparty C as Defendant D’s partner. Accordingly, the legal relationship formed between the said parties for the joint project was established.

B. Under the instant agreement, the Plaintiff invested KRW 95 million in the instant association from December 2, 2008 to April 8, 2009.

C. The instant cooperative deposited and managed the operating fund in the deposit account (Account I; hereinafter “instant cooperative account”) in the name of the Defendant D from December 2, 2008 to April 15, 2010. On April 15, 2010, the entire balance of the current account was transferred to the same cooperative account in the name of E, and E, from July 4, 2010, E managed the operating fund of the instant cooperative.
