1. The insurance contract concluded between the plaintiff and the defendant is invalid.
2. The defendant shall be the plaintiff.
Reasons
1. Basic facts
A. On May 27, 2009, the Defendant entered into an insurance contract on the separate sheet with the insured and the beneficiary as the defendant (hereinafter “instant insurance contract”).
B. As indicated in Table 1, the Defendant received hospitalization for 27 days in total from June 9, 2009 to July 2, 2009 and received KRW 20,861,352 in total from the Plaintiff in relation to the above hospitalization treatment by being hospitalized for 416 days on 27 March 15, 2014, including the fact that the Defendant received hospitalization for 24 days at B Hospital in charge, as shown in Table 1.
However, in the case of hospitalization in the table 1 Nos. 25 and 26, the defendant applied for insurance money to the plaintiff, but did not receive insurance money related thereto.
