1. Defendant A shall be punished by imprisonment with prison labor for a year and six months;

However, the above sentence shall be executed for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Defendant A

A. On November 5, 2018, the Defendant was issued a summary order of a fine of KRW 4 million for a violation of the Road Traffic Act at an Ansan District Court's Ansan Branch on the grounds that the Defendant violated the Road Traffic Act (driving) and the criminal records of the violation of the Road Traffic Act are only once.

On May 4, 2020, the Defendant moved to drive a car in a state of alcohol of about 0.152% of blood alcohol concentration from the 2km section from the 2km road in Ansan-si, Ansan-si to the front road in the same Gu D-do.

Accordingly, the defendant violated the Road Traffic Act's prohibition of drinking driving more than twice.

B. On May 4, 2020, the Defendant also tried to escape from crime: (a) on the road in front of the Gangseo-gu, Ansan-si; (b) under the influence of 0.152% of blood alcohol level, the Defendant was driving a E-car under the influence of alcohol level 0.152%; and (c) upon receiving a report of 112, the Defendant called, “I would like to make a report on drinking, and try to drive the vehicle,” and “I would like to drive the vehicle, I would like to drive the vehicle. I would like to say that I would like to make a false statement to the above police officer, because I would like to be punished when I would like to drive the vehicle.” (b) On the top of the car operation, I would like to say that I would like to say that I would drive the vehicle.

Since then, B discussed how to make a statement to the Defendant by the police station in order to receive the phone call, “I need to make an investigation on this case. I will have the Defendant make a statement to the police station.” In order to help B make a false statement, the Defendant stated to B that “I will make a statement as I would have driven at the time of drinking and so I would have to do so in the police investigation.”

B, on May 8, 2020, is present at the Ministry of Transport and Maritime Affairs in Ansan-gu office of the transportation survey department of the Ansan-gu Police Station located in 10, Ansan-gu, Ansan-si.
