A defendant shall be punished by imprisonment for six months.

Punishment of the crime

1. On March 7, 2017, the Defendant posted a letter stating that “Aphone 6S Gaz 64,” on the Internet bulletin board,” and then transfers KRW 270,000 to the victim C who reported and contacted this on the same day, he/she would deliver one cell phone to the victim C.

A false statement was made.

However, even if the defendant receives the payment from the injured party, he did not have the intention or ability to deliver the mobile phone.

As such, the Defendant, by deceiving the victim, was transferred KRW 270,000 in total to an enterprise bank account (Account Number D) in the name of the Defendant from the victim, around March 7, 2017, and KRW 240,000 in around March 10, 2017.

2. On May 10, 2017, the Defendant posted a notice stating that “game account is sold” on the Internet “Items” bulletin board on the same day and transferred KRW 180,000 to the victim E who contacted with the notice on the same day, if he/she wired KRW 180,00 to the victim E., he/she would transfer the “I” game account.

A false statement was made.

However, even if the defendant receives the payment from the injured party, he did not have an intention or ability to transfer the game account.

The Defendant, by deceiving the victim as such, received 180,000 won from the damaged party to the said account on the same day.

3. The Defendant, on August 2017, posted a letter stating that he had access to Puice North Korea in the vicinity of the territory of the Nam-gu Incheon Metropolitan City, the Defendant would deliver 180,000 won to the victim F who reported and contacted with the Defendant, who remitted 180,000 won to Puice F.

A false statement was made.

However, the Defendant did not possess the above goods and did not have the intention or ability to send the goods even if he receives the payment from the injured party.

On August 29, 2017, the Defendant was transferred KRW 180,000 to the Defendant’s Women-Friendly Gup Bank account (H) in the name of the Defendant.
