A shall be punished by imprisonment of 10 months, by imprisonment of 1 year, and by a fine of 5,00,000 won, respectively.
Reasons
Punishment of the crime
1. The joint crime committed by Defendants B and A shall not supply, sell, store, transport, or keep pseudo petroleum products, or supply, sell, store, transport, or keep petroleum products, petrochemicals, alternative fuel, or materials containing carbon and hydrogen, with a view to having them manufacture, import, sell, or store pseudo petroleum products with the knowledge that such products are pseudo petroleum products, or manufacture, use them as pseudo petroleum products;
G was leased from Gyeongcheon-si, Gyeongcheon-si, Gyeongcheon-si, a manufacturing plant of pseudo Petroleum Products, and registered as a business operator under the name of Defendant A with the trade name of “J”. After exercising overall control over the management of the above plant and the purchase of materials for pseudo Petroleum Products, Defendant B and Defendant A were in charge of fund management and selling pseudo Petroleum Products manufactured in the above plant.
On March 2, 2011, the Defendants sold an aggregate amount of KRW 1,50 litres equivalent to KRW 1,500,000,00 from November 12, 201, to March 7, 2011, using an underground storage tank (5), a ice connected to a newly installed storage tank, metres, etc., and a pseudo petroleum product to any L who has purchased pseudo petroleum products by driving K freight vehicles, with the aim of manufacturing or using pseudo petroleum products as pseudo petroleum products. The Defendants sold an aggregate of KRW 2,216,417 litres (4.2,8920,00,000,000,000) by mixing pseudo petroleum products with pseudo petroleum products with pseudo petroleum products.
Ultimately, in collusion with the above G, the Defendants supplied and sold petroleum products and petrochemicals for the purpose of manufacturing and selling pseudo petroleum products or manufacturing and using pseudo petroleum products.
2. The Defendant’s crime committed against Defendant C manufactures pseudo petroleum products.
