A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Criminal facts

The Defendant, as between B and Dong Western Branch, operated the “E soon Road” located in D located in the formernam-gun C in the name of B.

The Defendant, as a person of bad credit standing, was unable to obtain a credit card. The Defendant planned to use the credit card by stealing B’s name, i.e., by using the name of B, that he was aware of the personal information of B while operating the said “E promptly” under the name B.

Therefore, the Defendant, on September 2005, sentenced the Victim Samsung Card Co., Ltd. to the victim Samsung Card Co., Ltd. and lost the credit card as he did, obtained the Samsung Card in the name of B by means of an application for re-issuance, and acquired it by obtaining another credit card under the same method.

1. Fraud on the credit card in the name B;

A. On July 12, 2007, the Defendant entered into a credit card company with the victim’s new card company on July 12, 2007, and entered into a business partnership service with the business partnership service, and then called to a telemarket employee with whom the name of the portal company is unknown, and applied for a credit card issuance in the manner that he/she was aware of B’s personal information, and then received a new credit card issued in the name of B by registered mail from the old-nam-gun, Seoul Special Metropolitan City on behalf of the victim, and then registered by telephone.

Accordingly, the Defendant, by deceiving the victim company, received from the victim company a new card (credit card No. H) in the above-mentioned name B.

B. On November 14, 2007, the Defendant continued to use a computer at the Defendant’s home located in Seodaemun-gu Seoul, Seodaemun-gu, Seoul and applied for the issuance of a credit card in a manner of entering “B” and “J” into the name column of “CJ-N Card M/Mady” and “J” in the resident registration number column by accessing the victim’s website on the Internet at the Defendant’s home located in Seodaemun-gu, Seoul.
