A defendant shall be punished by imprisonment for not less than eight months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant was living together with the victim B from around 2000 to September 201 for about 11 years.
1. From September 201 to September 201, the Defendant: (a) was in custody of the Defendant and the victim’s house living together; (b) one Samsung (D) and one Hyundai Card (E) in the name of the victim for the victim during the period of living; and (c) was in custody of the Defendant and the victim for the victim; (d) requested by the victim to return two copies of the said card when the Defendant and the victim agreed not to live together with each other; and (e) did not return the said card to the victim for the purpose of continuing the use of the said card for the victim.
As a result, the Defendant embezzled the property owned by the victim without any justifiable reason and embezzled.
2. Fraud;
A. On March 5, 2012, the Defendant received one modern card (F) from the victim, even though the Defendant did not have a legitimate title to use the said new card, by deceiving C, 105 Dong 507, which was automatically renewed with the lapse of the validity period of 1 copy of the modern card (E) in B’s name used by the Defendant prior to B, and for the purpose of continuing use of the card. The fact was that the Defendant did not have a legitimate title to use the said new card but did so as B, and by deceiving the victim Hyundai Card Co., Ltd., the Defendant received one copy of the modern card (F) from the victim.
Accordingly, the defendant was given property owned by the victim by deceiving the victim.
B. On April 9, 2014, the Defendant automatically renewed the Samsung Card Co., Ltd. (D) in the name of Samsungcom Co., Ltd. used by the Defendant during the period of validity of the said Samsung Card Co., Ltd. and the Defendant’s use of the Samsung Card Co., Ltd. for the purpose of continuing to use the Samsung Card Co., Ltd., a new Samsung Card Co., Ltd., which was delivered to the address of the Defendant.
