A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[Criminal Power] On December 2, 2014, the Defendant was sentenced to a suspended sentence of two years on October 10, 2015 by imprisonment with prison labor at the Suwon District Court’s Eunpyeong Housing Site Board, and the said judgment became final and conclusive on July 11, 2015.
【Criminal Facts】
1. On February 2015, the Defendant: (a) was unable to obtain a credit card in bad credit standing; and (b) was able to use the credit card in the name of the Defendant’s son B.
On February 11, 2015, for the purpose of exercising the right of 104, 107, Dong-si, Dong-si, Hyundai Card Solicitors, D without authority, stated "B", "E", "E", "Gu-si C building", and "F" in the settlement account name column, and then forged six copies of the modern card application form, which are private documents concerning the rights and obligations of the name B, and exercised it.
B. Around June 4, 2015, the Defendant forged an application form for the membership of Samsung Card Member and the said event, without authority, required Samsung to enter Samsung Card F to the applicant column “B”, “H”, “H” in the resident registration number column (resident registration number substitution number), “H” in the address column, and “F” in the settlement account name column, and forged five copies of the application form for Samsung Card, which are private documents on the rights and obligations under the name of Samsung Card Member, and exercised it by having the Samsung Card Employee, who is aware of such fact, submit them en bloc to the applicant column.
2. On April 12, 2015, the Defendant paid the amount equivalent to 30,000 won of accommodation payment, by presenting the modern card issued in the name of “Kel” in the jurisdiction of the Seogu Daegu-gu, Daegu-gu, as if he were duly issued, to the employees of the said Moel as referred to in paragraph 2(a) of the said Article.
