Reasons
Punishment of the crime
Defendant A, B, and C, along with F and his name-free boxes, conspiredd to share the loan by taking advantage of the H’s resident registration certificate that Defendant B stolen with respect to H’s housing owned by Gangseo-gu Seoul Metropolitan Government 302, and Defendant C forged the lease contract with the lessee, thereby forging the lease contract and thereby taking part in the loan from Hyundai Capital Co., Ltd.
1. On July 10, 2012, Defendant A, B, and C have, without authority, enter and output in the column of the real estate in the form of the lease agreement at the J Licensed Real Estate Agent Office located in Gangseo-gu Seoul Metropolitan Government, the broker, “Seoul Gangseo-gu 302,” and “Seoul Gangseo-gu 302,00,000,000,000,000)” in the column of the deposit, the lessor’s name and resident number, and other personal information, such as the name and resident number, in the lessee column, and then enter and seal the lessor’s name and the seal of H in the lessor column, signed and sealed the lessor’s seal, signed and sealed C in the lessee column, affixed C’s seal, and signed and sealed C in the broker column.
As a result, Defendant A, B, and C conspired with each other to forge a lease contract under the name of H, a private document on rights and obligations.
2. On August 23, 2012, Defendant A, B, and C applied for a loan of the lease fund at the office of the Gangseo-gu Seoul Metropolitan Government Gangseo-gu Seoul Metropolitan Government Gangseo Finance Regional Group, and presented the forged lease contract to the employee in charge as if it was duly formed.
3. The Defendants A, B, and C, around August 23, 2012, offered a forged lease agreement at the office of the Gangwon Finance Area Group of the said Hyundai Capital Co., Ltd., and deceiving an employee in charge as if the lease agreement was actually concluded, and then deceiving the employee in charge as if the lease agreement was actually concluded, around August 28, 2012, KRW 84 million from the said Hyundai Capital Co., Ltd. as a loan for the entire loan.
