A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. The Defendant, against the victim bank, prepared a false lease contract with respect to F apartment Nos. 102 1209 and 1209, which was owned by E, together with the broker C, broker D, and lessor, as well as the broker E, and conspired to acquire the loan from the victim bank as collateral and distribute it.
On May 7, 2013, at the H real estate office located in Geumcheon-gu Seoul Metropolitan Government, the Defendant: (a) prepared an apartment lease contract with the lessee as the wife I; (b) the lessor as E; and (c) the period from May 15, 2013 to May 14, 2015; and (d) presented the loan staff as if the said apartment lease contract was actually prepared at the point of Germany-dong branch of the above bank, Geumcheon-gu, Seoul Metropolitan Government 1, 150-1, on May 2013, the Defendant presented to the loan staff as if the said apartment lease contract was actually prepared.
However, in fact, the defendant prepared a charter party contract for the purpose of preparing money, there was a separate tenant who resides in the above apartment, and the defendant did not think that he would actually move into the above apartment, and there was no intention and ability to repay the loan.
Around May 2013, the Defendant received KRW 80,000,000 from the employees in charge of the Korean Bank to the Agricultural Cooperative account in the name of E as a loan, and received KRW 20,000,000 among them according to the above public offering.
Accordingly, the defendant received property from the victim in collusion with one another C, D, and E.
2. Fraud to the victim J;
A. On October 1, 2013, at around 20:31, the Defendant made a false statement that “The Defendant shall pay back the amount of indemnity claimed from the present sea to the victim at the home of the victim JJ located in Gyeongcheon-gun, Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-do, and that “I will pay it later along with the interest, if it is paid back in lieu of the amount of indemnity to the modern marine account.”
However, the facts are that the defendant should pay back to the modern sea at the time.
