Defendants are innocent.

1. From March 9, 198 to February 28, 2012, Defendant A worked as the president at the victim D (hereinafter “D”) located in Chungcheongnam-nam (hereinafter “instant case”) and took overall charge of the instant D business, including the instant D’s leisure and reception business and community development business. From March 12, 2001 to March 12, 2005, Defendant A worked as the representative director at F in the same military E (hereinafter “instant corporation”) and took overall charge of the instant business affairs, including the instant corporation’s d’s d’s d’s d’, and the overall duties were performed as the representative director. From March 13, 2005 to October 6, 201, Defendant A took overall charge of the instant business affairs.

Defendant

B, from January 1, 2008 to February 20, 2012, while serving as the managing director of the instant corporation, B was actually in charge of the overall business of the instant D’s leisure, receiving, and community development project. From July 20, 2007 to August 13, 2010, the instant corporation was actually in charge of the instant corporation’s business upon Defendant A’s order while serving as the auditor of the instant corporation. From May 30, 2013 to the representative director of the instant corporation, B had overall control over the overall business of the instant corporation.

The Defendants, as seen above, purchased stone from the members of the instant D (hereinafter “members”) since 2004 from the operations of the instant D, paid fees after requesting the instant D corporation to do so, and received fees from the instant corporation in the form of credit purchase, such as selling the Doed rice, etc. (hereinafter “the instant welfare project”), and upon which the fees to be paid from the instant D would have difficulties in promoting various projects and expanding facilities being conducted by the instant corporation, the amount of the investment in the welfare project would be raised to KRW 2 billion through the general assembly of the instant D around February 2007. The instant corporation received the Doed rice purchased from the members of the instant D through the purchase of credit from the instant D.
