Defendant
A shall be punished by a fine of KRW 500,00, Defendant B and C, respectively, by a fine of KRW 700,000.
The above fine is imposed against the Defendants.
Reasons
Punishment of the crime
1. On December 23, 2009, Defendant A entered “G”, “H”, “H”, “one million,” and “one million,” in the column of a rent in the lessor’s site for a real estate lease contract prepared in advance for the purpose of uttering at the Seongbuk-gu Seoul cafeteria, Seoul, and marked on the lessor’s column of the site for another real estate lease contract, Defendant A stamped the seal of the Dong, which is drawn up from G to the lessor’s site for another real estate lease contract, and affixed the seal of that person in the same way as “G”, “H”, “H”, “one million,” and “one million,” respectively.
As such, for the purpose of uttering, the Defendant forged two copies of a lease contract in the name of G, a private document on rights and obligations.
2. In order to use the Defendant’s I restaurant tax less than the amount of tax on the Plaintiff’s I restaurant, Defendant B forged the lessor’s name and asked the lessor to prepare two copies of the real estate lease contract entered into by H as the lessee, and let the lessee forge the lease contract.
Therefore, the defendant allowed A to prepare two copies of the G name lease agreement in the same way as that of the preceding paragraph.
For the purpose of exercising, the Defendant instigated A to forge two copies of the lease agreement under the name of G, a private document on rights and duties.
3. Defendant C
A. On January 7, 2010, the Defendant submitted to the staff in charge of Seongbuk-gu in charge of Seongbuk-gu, Seoul, a letter of lease agreement of KRW 10 million, monthly rent of KRW 1400,000,000, which was forged in the name of the lessor G, as prescribed in the above paragraph (1), to use the business registration in the name of H in the Seongbuk-gu, Seongbuk-gu, Seoul, 3-2 Seongbuk-gu, as if it were a document duly formed.
B. The Defendant is located in Seocho-gu Seoul, Seocho-gu on March 7, 2012.
