1. The defendant shall add to the plaintiff.
[Attachment 1 drawings on land of 22,875 square meters of Busan Nam-gu, 1.2,2,3,45 square meters, 1.1.
Reasons
1. Facts of recognition;
A. On December 30, 2013, the Plaintiff obtained authorization for the implementation of the E residential environment improvement project conducted in Busan Southern-gu D (hereinafter “instant project”); and on December 30, 2013, pursuant to Article 28(1) of the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (wholly amended by Act No. 14567, Feb. 8, 2017; hereinafter “former Urban Improvement Act”); and on January 8, 2014, the remaining head of Busan-gu Busan Metropolitan City publicly notified such authorization pursuant to Article 28(4) of the same Act.
B. The Defendant, as the owner of an unauthorized Building (hereinafter “the Building No. 1”) with a size of 46 square meters connected each point in sequence, shall occupy the building on the ground of 22,875 square meters of land owned by the Republic of Korea in Busan, Nam-gu, Busan, which is located within the instant project site.
다. 피고는 이 사건 사업 부지 내에 있는 원고 소유의부산 남구 C 임야 2,600㎡ 지상에 F 소유였던 별지 2도면 표시 ①,②,③,④,⑤,⑥,⑦,⑧,⑨,①의 각 점을 순차로 연결한 선내(가)부분 57.41㎡의 무허가건물(이하 ‘이 사건 제2건물’이라 한다),G 소유였던 별지 3도면 표시 ①,②,③,④,⑤,⑥,⑦,⑧,⑪,①의 각 점을 순차로 연결한 선내(가)부분 34.47㎡,별지 3도면 표시 ⑧,⑨,⑩,⑪,⑧의 각 점을 순차로 연결한 선내(나)부분 3.40㎡의 각 무허가건물(이하 ‘이 사건 제3건물’이라 한다)의 임차인으로서 위 각 건물을 점유하고 있다. 라.
On October 15, 2018, the Plaintiff agreed to pay KRW 40,760,050 for obstacles to the instant building No. 2, etc. between F and F, and around that time, paid KRW 40,760,050 to F.
E. The Plaintiff did not reach an agreement with the Defendant, G, and the instant building Nos. 1 and 3. As such, the Central Land Expropriation Committee applied for adjudication on expropriation, and the Central Land Expropriation Committee applied for adjudication on expropriation.
