피고인은 위 C, D, F, G, H, I 등과 함께 2012. 5. 27. 14:00경부터 같은 달 28. 22:40경까지 울산 울주군 E 소재 창고건물에서 게임물등급위원회로부터 등급분류 받지 않은 야마토 게임기 10대, 바다이야기 게임기 25대를 각 설치한 다음, 그곳에 온 손님들에게 이를 이용하게 하면서, 피고인은 게임장 밖에서 문방을 보고, 위 F는 속칭 ‘바지사장’으로서 손님접대 등 심부름을 하고, 위 G은 손님들에게 위 게임장의 위치를 알려주지 않기 위해 차량 창문을 검게 만든 속칭 ‘깜깜이 차량’을 운전하여 손님들을 위 게임장으로 실어 나르고, 위 H은 게임장 안에서 손님접대 등 심부름을 하고, 위 I은 게임장 내에서 환전업무를 비롯하여 영업총괄을 담당하였다.
