Defendant shall be punished by imprisonment for a term of four years and six months.

The defendant shall complete a program to prevent the arrangement of commercial sex acts for 80 hours.

Punishment of the crime

Around March 2, 2018, the Defendant proposed that “B (n), who is a child or juvenile, (hereinafter referred to as “the continuous “term”) against the male sex, will take half of the payments for sexual traffic from sex purchase,” and that B accepted the Defendant’s proposal.

이에 따라 피고인은 2018. 3. 5. 19:06경 스마트폰 채팅 어플리케이션 'C'을 이용하여 B의 프로필을 게시하고, 이 프로필을 보고 대화를 건 손님을 가장한 순경 D에게 피고인이 성매매 여성인 것처럼 가장하여 “164-50-b 1-15 2-28 입4 질4 ㅎ장 사절 69, 버빨, 손가락, ㅋ1스 가능 이동 사진no 갠 바루봐요. 사진 안뿌립니다.”라는 내용의 문자 메시지를 보내고, D과 안산시 단원구 E에 있는 F병원으로 약속장소를 정하고 1회 성관계에 성매매 대금 15만 원 또는 2회 성관계에 성매매대금 28만 원을 받기로 약속한 후, 피고인이 렌트한 G K5 승용차에 B를 태우고 위 약속한 장소로 이동하여 B로 하여금 D과 성관계를 할 수 있도록 알선한 것을 비롯하여, 2018. 3. 3.경부터 2018. 3. 5.경까지 B로 하여금 불특정 남성들을 상대로 성관계를 하도록 하고 그 대금으로 합계 125만 원의 이익을 얻어, 아동ㆍ청소년의 성을 사는 행위를 알선하는 행위를 업으로 하였다.
