Reasons
Punishment of the crime
On May 26, 2020, the Defendant: (a) received a proposal from an employee of singinginging on the name, who came to know through Internet job seeking advertisements, that “The Defendant will receive cash by moving to a designated place within the country and give KRW 100,000 or KRW 1,50,000 per day to the designated account for deposit without a deposit account; and (b) conspired with the employees of financial institutions under the direction of the person without a name, who assumes the name, and deliver money from the victims, in sequence, to the so-called “passing” role.
On June 2, 2020, the name-freeist made a false statement to the effect that “a loan can be made at low interest” and “an application for a loan to another financial institution in a situation where an existing loan has been made is a violation of the Financial Law. It is possible to make another loan to repay the existing loan.”
However, in fact, the name-oriented person was not an employee of the financial institution, and there was no intention or ability to provide loans to the victim.
At around 16:45 on the same day, the Defendant moved to Dado-gun, Jeonnam-do-gun, according to the direction of the person without a name, and was charged to the victim as an employee of financial institution, and deposited the account without a name from the victim to the account designated by the person without a name, with a cash of KRW 18.65 million, from June 9, 2020 to June 9, 2020, the Defendant received a total of KRW 15.57 million from 6 victims, and delivered the account without a name to the person without a name.
In this respect, the defendant, in collusion with the employees in charge of singing out the name, by deceiving the victims to acquire the property.
