Reasons
Punishment of the crime
The defendant is the female president of the Goyang-gu Incheon Metropolitan City C Apartment, and the victim D was the representative president of the above apartment house from May 25, 2012 to December 31 of the same year.
1. From December 20, 2012 to December 21, 2012, the Defendant: (a) around 50 residents living in the above apartment building 602 Dong, including E, from around December 20, 2012 to around 21 of the same month, “C from the strategy to the above 602 Dong shall take office as the president of the Dong representative and opening a new account of KRW 300 million of the public fund in the complex to another bank shall not be pointed out. If the money is no reason to do so, and if it is inevitable to do so, it should have taken office through a resolution of the said representative. The Defendant, without going through a resolution, provided that there is no reason to create a new account; (b) there is no reason to create a new account; and (c) obtained a signature by showing the inducement that the victim has deposited KRW 300 million in a new account without obtaining a resolution of the representative of the apartment, leaving the fact that the victim deposited the public fund without permission as if the victim deposited it in the new account.
However, the above apartment council held on July 17, 2012 proposed a bill to deposit the long-term repair appropriations deposited in MMF on a fixed deposit with high return rate of profit, and the defendant was also aware of that fact.
Nevertheless, the Defendant distributed the printed matter containing false facts to many unspecified people residing in the apartment, thereby impairing the honor of the victim.
2. From December 22, 2012 to December 26, 2012, the Defendant: (a) the instant apartment complex 601 Dong, 602 Dong, 603 Dong, 605 Dong, 606 Dong, 607 Dong, 608 Dong Dong, 609 Dong Dong, and (b) the instant apartment complex 6 complex public funds amounting to KRW 300 million within the instant apartment complex, without going through the Dong representative meeting; and (c) the head of the relevant bank alone as another bank.
