1. The Defendant’s KRW 32,837,00 for the Plaintiff and KRW 6% per annum from August 13, 2014 to November 5, 2015.
Reasons
1. The description of the claim is as shown in the annexed sheet of claim.
2. Judgment without holding any pleadings (Article 208 (3) 1 and the main sentence of Article 257 (1) of the Civil Procedure Act);
3. Partial dismissal of the lower court: (a) pursuant to the provisions on statutory interest rates under the main sentence of Article 3(1) of the Act on Special Cases concerning Expedition, etc. of Legal Proceedings (amended by Presidential Decree No. 26553, Sep. 25, 2015; (b) October 1, 2015, which entered into force on October 1, 2015; (c) recognized damages for delay calculated at the rate of 15% per annum from November 6, 2015, the day following the delivery date of the instant complaint, to the day of full payment; and (d) recognized the excess portion’s claim.
