Punishment of the crime
C. D is a person who has entered into a lease agreement with the Korea Land and Housing Corporation, which is a rental business operator, and the Defendant is a person who engages in real estate brokerage business called ‘mix-type'.

In addition, C/D was well aware that a lessee of a rental house may not transfer or sublet the right of lease to any third party, and no one shall arrange for such transfer, unless any justifiable reason, such as “work, disease treatment, and livelihood,” occurs after he/she actually moved in the rental apartment.
1. On May 2009, the Defendant: (a) requested transfer of the occupant winning 501, 204, 501, and 204, which was implemented by the Korea Land and Housing Corporation; (b) received the entire documents necessary for the succession of rights, such as a certificate of the personal seal impression; and (c) assisted transfer of the right to lease by receiving KRW 13 million from F from F at the real estate brokerage office operated by F on May 25, 2009; and (d) transferred the entire documents to another person to transfer the right to lease.
2. Around March 8, 2009, the Defendant received KRW 17 million from D to a person who was requested to transfer the subscription savings account and whose name is unknown, and transferred the account to the Korea Land and Housing Corporation after receiving KRW 17 million. Upon receiving the application from the occupant of the G apartment in emulsified G apartment executed by the Korea Land and Housing Corporation, the Defendant was selected as an occupant under 508 Dong 302, and received all documents necessary for the succession of rights, such as a certificate of personal seal impression, from the above D, and requested a transfer of the winning receipt from a person whose name is unknown. On June 8, 2009, at the real estate brokerage office operated by the above F, the Defendant transferred the entire documents to F with the transfer of the right of lease.
