Punishment of the crime

[criminal history] Defendant B was sentenced to a suspended sentence of two years for a year of imprisonment due to a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (domination award) at the Suwon District Court on September 7, 2017 and the judgment became final and conclusive on September 15, 2017.

[ all facts] On March 31, 2017, I Agricultural Cooperatives: (a) held an election to elect one non-standing director as a representative of the union members in four different regions; (b) Defendant A and Defendant B went out in the district of J, and Defendant C was elected; (c) Defendant C was elected due to Defendant C and Defendant D’s going out in the district of K; (d) Defendant E and Defendant F were elected due to Defendant E and Defendant F’s going out in the district of L; and (e) Defendant E were elected solely in the M district of M.

G and Defendant H are representatives of the above Agricultural Cooperatives who have the voting right in the election.

[Criminal facts] No person shall provide money to, or receive money from, members of the agricultural cooperative for the purpose of winning the election as executive officers of the local agricultural cooperative.

1. Defendant A, the Defendant

A. On the top of the office of representative P, a member of Pyeongtaek-siO on March 2017, 201, he/she first asked the P to “the foregoing P” election, and returned to the P inception bag containing 300,000 won in cash on the truck driver’s seat while making a horse and hedging;

(b) in front of the house of H, a representative in Pyeongtaek-si Q, at around 17:00 on March 26, 2017, containing 300,000 won in cash to the said H;

(c) in a cafeteria operated by members G, a representative in Pyeongtaek-si R on March 28, 2017, with a cash of KRW 300,000,000,000 for that G;

D. On March 2017, 2017, in front of the office of U’s representative U, who is a member of Pyeongtaek-si T, said U, the said U, “ well-written request,” the U rejected the said request. However, U, inasmuch as 300,000 won in cash was presented.

Accordingly, the suspect is the I Agricultural Cooperatives.
