Defendants are not guilty.
Reasons
1. Defendant A was elected on August 9, 2017 by going to the “special election for the president of the C Agricultural Cooperative in 2017”, and Defendant A, as executive director of the C Agricultural Cooperative at the time, is the spouse of D, a special election for the interest of the members of the C Agricultural Cooperative, who is the principal director of the C Agriculture Cooperative.
1. Defendant A
(a) No one shall visit the elector door to door or gather at a specific place for an election campaign, in order to conduct an election campaign;
Nevertheless, the Defendant visited D and her spouse’s house located in E Apartment F head around 19:00 during the period from July 2, 2017 to August 2, 2017, in order to provide bags containing a total of KRW 3 million in cash of KRW 50,000,00 to the spouse B of the said elector in a special election for the head of CF cooperative.
2) No one shall offer, express an intention to offer, or promise to offer money, goods, entertainment, other property benefits, or public or private positions to an elector (including a person eligible to be recorded on the electoral registry before preparing the electoral registry), his/her family member, or an institution, organization, or facility established and operated by the elector or his/her family member, for the purpose of an election campaign leading to number and understanding.
Nevertheless, from July 2, 2017 to August 2, 2017, the Defendant found at the 19:00 house of the spouse D’s spouse located in E apartment F head around 19:00, and asked B to the effect that B would assist himself/herself in a special election for the head of CF head of C agricultural cooperative.
“In doing so, bags containing a total of KRW 3 million in total of KRW 60 million in cash.”
(b) A person who violates the Agricultural Cooperative Act shall be a member or his/her family member, or a member, for the purpose of getting himself/herself or a specific person elected or not elected as an executive officer or representative of a local agricultural cooperative; or
