A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around 20:47 on December 15, 2014, the Defendant driven a B rocketing car under the influence of alcohol concentration of about 0.089% without obtaining a driver’s license on the section from the front side of the “fluent rain” located in the Mineyang-Eup in the Mineyang-si to the front side of the same Eup/Myeon, and without having obtained a driver’s license on the section of approximately 1.5km to the roads in front of the Taeyang-gu Seoul Metropolitan City.
2. When the Defendant was discovered by a police officer who is under the influence of drinking while driving a car as set forth in the above 1.1, the Defendant was aware of the fact of driving the car without obtaining a driver’s license, so it would be difficult to detect the fact of driving the car while under the influence of alcohol, and thus, he was aware of it as if he was C.
On December 15, 2014, at around 20:57, the Defendant: (a) notified C’s name, traffic, and traffic control assistant D of the name, resident registration number; (b) continuously, through the PDA screen, C’s signature in the signature column of the driver of the drinking driving control that entered C’s personal information and the violation of the regulations; and (c) requested D to transmit D the results of the drinking driving control to the traffic computer network at around that time.
Accordingly, for the purpose of exercising authority, the Defendant forged C’s private signature without authority, and exercised C’s false signature as if it were duly formed.
3. The Defendant forged private document: (a) was asked of the background of drunk driving from the foregoing D at a time, at a place; (b) the driver’s name column in the name column; (c) resident registration number column; (d) “E”; and (c) “E” in the column in the location column of the date and time of detection; and (d) the driver’s name column.
