A defendant shall be punished by imprisonment with prison labor for not more than ten months.

Punishment of the crime

On December 15, 2009, the Defendant was issued a summary order of KRW 500,000 as a penalty for fraud at the Ulsan District Court, and on November 29, 201, the same court issued a summary order of KRW 700,000 as a penalty for fraud; on June 10, 2013, the same court issued a summary order of KRW 300,000 as a penalty for fraud; on March 11, 2014, the court issued a summary order of KRW 1,00,000 as a fine for fraud; on April 21, 2014, the Defendant was issued a summary order of KRW 5,00,000 as a penalty for fraud at the same court on July 15, 2015.

1. On April 2015, the Defendant habitually committed a single-name “Domini” service, a single-name loan service, both a week, at the “E” of the victim D’s operation located in Ulsan-gun, Ulsan-gun, Ulsan-gun, and ordered the victim to provide the alcohol value.

However, there is no money in the number of the defendants, and there is no intention or ability to pay the alcohol value to the victim.

As a result, the defendant deceivings the victim, and acquired a total of 220,000 won of property benefits, such as the Domin service, from the victim.

From that time until December 13, 2015, the Defendant acquired a total of 2,370,000 won from the victims on five occasions, such as the list of crimes in attached Form 1 in the same manner.

Accordingly, the defendant acquired property benefits from victims more than five times habitually.

2. On December 2, 2015, the Defendant: (a) on December 2, 2015, 02:0, 02:00, the Defendant found a 400,000 won in cash, which is the victim’s possession; (b) KRW 400,000,000,000, Samsung Card 1; (c) one copy of the operation license; and (d) one 1.50,000,000,000,000,000 won in the market.

Defendant 1 did not take necessary procedures, such as returning the above acquired property to the victim.
