Defendant

A shall be punished by a fine of 2 million won, and by a fine of 700,000 won.

The above fines are imposed by the Defendants.

Punishment of the crime

Part of the facts charged is revised without following the amendment of indictment to the extent that it seems that there is no concern about actual disadvantage in the exercise of the accused's defense right.

Defendant

A is the head of the 'G Hospital's residential facility for persons with disabilities, which is operated by the Social Welfare Foundation F, a living facility for persons with disabilities, and Defendant B is the head of the 'H Hospital's residential facility for persons with severe disabilities operated by the above F.

In the I City, in order to support living expenses, such as food and clothing expenses, etc. for persons with disabilities, subsidies consisting of (80%) State expenses (80%) and Do expenses (10%) and Si expenses (10%) have been granted to G hospitals and H hospitals every month. The Defendants shall use the above subsidies only for the living expenses of persons with disabilities and shall not use them for purposes other than their original purposes.

1. Defendant A

A. From January 201 to December 201 of the same year, the Defendant used KRW 12,106,972 out of the total of KRW 407,151,560 of the subsidies for living expenses of disabled persons in 2011 paid at the above G hospital office for the purpose of food expenses of the employees working at G hospital. From January 201 to December 201 of the same year, the Defendant used KRW 7,684,570 out of the subsidies for living expenses of disabled persons in 2012 for the purpose of food expenses of the employees working at G hospital from January 2012 to December 201 of the same year. From January 2013 to December 2013 of the same year, the Defendant used KRW 7,684,570 out of the subsidies for living expenses of disabled persons in 2013 for the purpose of food expenses of the employees working at G hospital.

B. On January 26, 2012, the Defendant used 323,000 won of the subsidies for the living expenses of disabled persons provided by the K K station located in the Chungcheongnam-Nam-J for the purchase of oil by November 14, 2013 from that time, and used 6,241,910 won of the subsidies for the living expenses of disabled persons provided by the I Si 15 times in total, as shown in the list of crimes in the attached Table, for purposes other than the living expenses of disabled persons (the Defendant A spent this part of the subsidies for the living expenses of disabled persons).
