A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

around October 15, 2013, the Defendant posted an advertisement to the effect that “I sell content game equipment” was the same as the above advertisement at the Defendant’s office located in Changwon-si, Changwon-si, Changwon-si, and on the Internet site of "Jinna,” and “I sell content game equipment.” The Defendant reported and contacted the advertisement to the victim C.

However, even if the defendant receives the payment from the victim, he did not have the intention or ability to sell the game machine to the victim.

The Defendant, by deceiving the victim as above, received KRW 155,00 from the victim’s bank account (D) in the name of the Defendant on the same day from the victim, and by deceiving the victims through the same method 16 times from October 25, 2013, as shown in the list of crimes in the attached Table, and fraudulently acquired KRW 2,265,50 by deceiving the victims through the same method from October 25, 2013.

The Defendant, around October 17, 2013, posted an advertisement to the effect that the Defendant sold content games at the Defendant’s home located in Changwon-si, Changwon-si, Seoul-si, and on the website of the “Jinna,” and sold it to the advertising window. After reporting and communicating the advertisement, the Defendant made a false statement to the victim E to the same effect as the above advertisement.

However, in fact, the Defendant posted the above advertisement on the idea that only sales proceeds will be remitted from the beginning, and even if he received the money from the victim, he did not have the intent or ability to sell the above game machine.

The Defendant, by deceiving the victim as above, received 155,00 won from the victim to the national bank account (D) in the name of the Defendant on the same day and acquired it by deception.

Around September 9, 2013, the Defendant posted a false statement to the victim F who had contacted him/her with “Tindo” by accessing Internet NAVER Kindo at the Defendant’s home located in Changwon-si, Changwon-si, Masan, and selling “Tindo.”
