A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Where an electronic bid for the supply of food materials in the School Meal Electronic Procurement System (EAT) which is operated and managed by the Korea Agricultural and Fishery Products Distribution Corporation, no bid shall be conducted by lending the name of any other company, or the same public announcement shall be conducted in duplicate in the same area.

Nevertheless, on September 17, 2012, the Defendant: (a) established and operated school meal ingredients suppliers (f) under the name of E in the name of E in Dong-gu Daejeon-gu, Daejeon; (b) established a group of food materials suppliers participating in “school meal electronic bidding”; and (c) established a number of food materials suppliers using the name of friendly-gu, employee, etc. for the purpose of raising the successful bid rate; (d) established a number of food materials suppliers under the name of friendly-gu, Daejeon-gu, Daejeon-gu, Daejeon-gu, Daejeon in order to make a duplicate bidding on the same public notice; (e) “H” in the name of the Defendant in the name of Dong-gu, Daejeon-gu, Daejeon-gu, Daejeon-gu, Daejeon in the first place of sale; and (e) opened a bid in the name of friendly-gu, Daejeon-gu, Daejeon-gu, Daejeon-gu, Daejeon in the first place of sale; and (e) opened a bid in the name of 30-Gu, Daejeon-gu, Daejeon in the name of 15.

On May 23, 2013, the Defendant was awarded a bid of KRW 5,681,746,980 in total over 690 times from that time until October 26, 2016, for the bid price of “R” bid ordered and managed by the Korea Agriculture and Fisheries Food and Drug Distribution Corporation in advance, which is the bid price of KRW 2,815,80 in the name of “(State)F” and “H” in the name of “(State) H”, and received the bid price of KRW 2,815,80 in the name of “H”.

In this respect, the defendant is a deceptive scheme.
