A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

When an electronic bid for the supply of food materials in the "School Meal Electronic Procurement System (EAT)" by the cyber exchange operated and managed by the Korea Agricultural and Fishery Products Distribution Corporation, it shall not be allowed to lend the name of another company or to make a bid for the same public announcement in the same area.

Nevertheless, since December 206, the Defendant established and operated “A” corporation in Jung-gu, Daejeon, Daejeon. Around September 1, 2015, the Defendant established a school meal service provider of the level of schools at each level of Daejeon, under the “EAT” of the cyber Exchange of Agricultural and Fishery Products operated and managed by the Korea Agricultural and Fishery Products Distribution Corporation for Food and Fishery Products (EAT), intended to establish the same bid on the same case for the purpose of raising the successful bid rate for the supply of meal service materials in the school meal service in the name of the same bidding and to make double bidding. Around February 7, 2014, the Defendant announced that “H” was in the Jung-gu, Daejeon under the name of the above E employee I, Daejeon U.S., Daejeon J and 1 in the name of the above E employee I, established a school meal service provider of food materials at each of the first level of schools, and conducted the same bid in the name of each designated company in advance, provided that each of the designated bidding was conducted in the same way.

On March 19, 2014, the Defendant, at the office, etc. of the Korea Agricultural and Fisheries Food Distribution Corporation, (i) participated in the tender of the “Public Notice of Submission of Estimated Number of Food Materials of L Middle School” (Supplementary) managed by the Korea Agricultural and Fisheries Food Distribution Corporation in the name of “H”, and (ii) instructed M et al. employees, etc. to participate in the name of “H” in the name of “H”, and (iii) the said M was awarded a successful bid amount of KRW 4,520,000 in the name of “H” by participating in the tender or by means of direct participation by the Defendant in the tender in accordance with the direction, and (ii) was awarded a successful bid for the said supply contract at KRW
