A defendant shall be punished by imprisonment for one year.

Each request for compensation order shall be dismissed by an applicant.

Punishment of the crime

On March 27, 2017, the Defendant posted a notice to the effect that “The victim C will buy a mobile phone,” by using the Defendant’s mobile phone at the Defendant’s dwelling at Goyang-si, Goyang-si, 103 Dong-dong, 1103 Dong-dong, Goyang-si, and accessing the Internet and trading site of goods, using the Defendant’s mobile phone, thereby making it false to the victim that “I will sell a mobile phone.”

However, even if the defendant receives money from the injured party, the defendant did not have the intent and ability to sell the mobile phone.

Nevertheless, the Defendant, by deceiving the victim, received 300,000 won from the victim to the Agricultural Cooperative Account (G) in the name of the Defendant, and received 2,490,000 won in total from 10 times as shown in the list of crimes in the attached Form.

1. On May 29, 2017, the Defendant: (a) posted a letter stating that “the sale of Aphones” is “the sale of Aphones” on the Internet Access “F Roster”; and (b) reported it to the victim H, who called the victim H, did not have the intent or ability to sell Aphones for KRW 300,000,00; (c) however, even if the Defendant received the payment from the victim, the Defendant did not have any intent or ability to sell Aphones.

Ultimately, the Defendant, by deceiving the victim as above, received 300,000 won from the victim, under the name of the Defendant, in the name of SC Bank account (I) in the name of the Defendant.

2. On June 27, 2017, the Defendant: (a) posted a notice on the Internet Round “Round” page on the Internet (hereinafter “Round”) around June 27, 2017; and (b) contacted the victim with the victim J to sell the victim at KRW 2.50,000,00 to the victim. However, even if the victim received payment from the victim, the Defendant did not have any intent or ability to sell the Bab to the victim.
