A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

[2016No. 174] On August 18, 2015, the Defendant: (a) at the D coffee shop located in Changwon-si, Changwon-si; (b) on August 18, 2015, the Defendant thought that he/she would have obtained a loan by leasing a vehicle to a broker whose name is unknown, not by driving the vehicle for the purpose of operation; (c) at the time the credit rating was the lowest level; (d) there was no particular property and income; and (e) the vehicle deposit was in the situation where the said broker paid the vehicle, and even if he/she did not have the intent or ability to pay the rental fee, the Defendant, the representative director of the victim E, stated that “I will pay the Lone Star Scom She She She she will pay it with the account no later than 25th day of each month; and (b) he/she obtained the victim’s money from the victim with the amount of KRW 2150,800,000,00 from the victim.

[2016No. 277] On September 9, 2015, the Defendant: (a) around 11:30 on September 11, 2015, at the Seocho-gu, Changwon-si, Seocho-gu; (b) at the time, the Defendant thought that he/she would be granted a loan by leaving a vehicle to a broker who is not operating for the purpose of operation but is unable to identify the vehicle’s name; (c) at the time, the credit rating was the lowest level; (d) there was no particular property and income; and (e) even if he/she did not have the intent or ability to pay rental fees even if he/she rents a vehicle because the broker paid the vehicle, he/she did not have the intent or ability to pay rental fees, the Defendant, an employee of Samsung Samsung F&C, “The purpose of operation is to pay the Lone Star T&C to the account on the 25th day of each month; and (d) the Defendant acquired the victim’s money from the victim to the 26.7 million won x 27080,08 months.
