A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On April 11, 2017, at a parking lot located in Gangnam-gu Seoul Metropolitan Government (Seoul), the Defendant: (a) placed a victim C (27 years old) (a person who has been suffering from a dispute arising in the course of telephone calls and has been suffering from the actual site; and (b) placed a higher drinking size and placed the victim on his/her hand, and (c) placed the victim on his/her hand, and (d) discarded.

“A threat,” such as “Abandon the road, left hand of the victim’s right side while throwing off the said stone, and making one time the part of the victim’s right side.

Accordingly, the defendant, carrying dangerous things, threatened the victim with threat, and injured the victim on the right side side, which requires treatment for about four weeks.

1. 소견서, 상해 진단서, 진료 기록부 [ 위 증거들에 의하면, 피고인이 2017. 4. 11. 21:00 경 피해자의 오른쪽 광대뼈 부위를 손바닥으로 1회 때린 사실( 목 격자 D는 당시 ‘ 쫙’ 하는 소리가 났고, 소리로 보아 살살 때린 것은 아니라고 진술하였다), 피해자는 얼굴이 부어 다음날 E 성형외과의원에서 방사선 촬영 등의 검사를 받았고, 위 병원은 피해자에 대하여 약 4 주간의 치료가 필요한 오른쪽 관골 부 변 위 및 오른쪽 관골 부위 타박상 진단을 한 사실, 한편 피해자는 2015. 11. 14. 위 병원에서 양쪽 광대 부위에 대한 성형수술( 퀵 광대 축소 술) 을 받았고, 그 무렵부터 이 사건에 이르기까지 별다른 치료나 시술을 받지 않은 사실, 이 사건 이후 촬영된 CT 영상( 증거기록 33 면) 상 오른쪽 광대뼈 부위의 접합 부분은 함께 성형수술을 받았던 왼쪽 부위 접합 부분과는 확연한 차이를 보이고 있는 사실이 인정된다.

The date of the victim's injury diagnosis and the date of the diagnosis are close to the time of the occurrence of the injury, and there is a reason to suspect particularly credibility in the process of the issuance thereof.
