Reasons
Punishment of the crime
On May 17, 2012, the Defendant was sentenced to a suspended sentence of two years on May 25, 2012 by imprisonment with prison labor and six months for violating the Financial Investment Services and Capital Markets Act at the Seoul Eastern District Court on May 17, 201.
[2011 Highest 2111] The defendant is the representative of the DY building CY building in Seongbuk-gu, Sungnam-si, which is a business operator who conducts manufacturing business with 113 full-time workers.
1. The Defendant worked in the above workplace from September 1, 1999 to May 31, 2010 and did not pay 2,410,464 won of wages and retirement allowances to EA that retired from the workplace within 14 days from the time of retirement without an agreement on the extension of payment deadline between the parties concerned, and did not pay 51,503,505 won of wages, retirement allowances, and annual paid leave allowances for EB, EEC, ED, EE, EF, C, EG, EA, EH, and EI, as described in attached Form (a), within 14 days from the date of retirement without an agreement on the extension of payment deadline between the parties concerned.
2. A business operator shall pay wages to regular workers on a fixed day not less than once a month, and an annual paid leave not less than the annual paid leave shall be paid on the first payment day after the right to claim the annual paid leave expires; and
The Defendant did not pay KRW 15,954,740, total amount of wages from July 1, 2011 to October 1, 2011 to workers Q Q who worked in the above workplace from June 1, 1998, on the 5th day of each month, which is the date of the regular payment of wages, and paid KRW 3,563,065, the annual paid leave allowance of KRW 3,563,065 on the 5th day of each month, and on the 5th day of January each year, which is the date of termination of the right to claim annual paid leave after the date of termination of the right to claim annual paid leave, as shown in attached Table (b), to employees EJ, Q, EK, E, M, and EM, total amount of KRW 73,200,851,000 on the 5th day of each month, which is the date of the regular payment of wages and annual paid leave.
