Reasons
Punishment of the crime
The defendant of "2014 Highest 544" is the person who employs 20 full-time workers in the following City C and operates (ju) D.
1. Violation of the Labor Standards Act;
A. The Defendant, while working in the foregoing workplace on March 10, 2014, did not pay KRW 6,274,396, including the total of KRW 1,109,546, and the total of KRW 6,274,396, on November 1, 2012 of E-employee E who retired from office on March 10, 2014, within 14 days from each retirement date, without any agreement on extension between the parties to the payment date.
B. Although wages are paid at least once a month on a fixed date, the Defendant did not pay wages of KRW 1,623,878 on August 201, 2012, including KRW 1,623,878 of the worker F working in the above workplace, and KRW 31,582,454 on the monthly regular wage payment date, as stated in the attached crime list.
2. The Defendant violated the Guarantee of Workers' Retirement Benefits Act, while serving in the pertinent workplace on March 10, 2014 and did not pay the retirement allowances of 3,518,532 won as well as 7 employees Nos. 3 through 7, 10, and 13 in total, 25,87,823 won in addition to the retirement allowances of 7 employees, as described in the attached Table of Crimes List of Crimes, within 14 days from the date on which each of the causes for the payment of retirement allowances occurred, without any agreement between the parties
The defendant of the "2014 Highest 791" is the person who employs 20 full-time workers in the following City C and operates (ju) D.
When a worker retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such retirement occurred.
1. The Defendant violated the Labor Standards Act, while working in the said workplace, did not pay KRW 1,476,173 of G workers G retired on April 7, 2012, wages of KRW 1,476,173 on October 7, 2012, wages of KRW 1,476,173 on November 2012, within 14 days from the date of retirement without an agreement between the parties on extension of the due date.
