A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Trading of philophones and giving or receiving them;
A. On September 28, 2012, around 20:00, the Defendant received from D a single-use injection machine from D without compensation, which contains 0.06g 0,000 g of Mesofts (hereinafter “copon”).
B. At around 00:00 on October 27, 2012, the Defendant received one disposable injection device from D without compensation, which contains 0.06 g of philopon in front of a cafeteria located in the operation Dong of Gyeyang-gu Incheon, Gyeyang-gu, Incheon.
C. On November 3, 2012, at around 16:10 on November 3, 2012, the Defendant received, without compensation, one disposable injection device that contains D’s 0.1g from D, and received and delivered it.
At around 23:40 on December 7, 2012, the Defendant: (a) obtained I’s franchise from H located in Seosan City G; (b) received 0.03g of philopon from I without compensation; and (c) received it.
E. At around 01:50 on May 8, 2013, the Defendant: (a) extracted I’s franchise from K University, which was parked in the J of K University on the GJ of Yong-si; (b) transferred 1.6 million won to I; and (c) received from I a single injection instrument containing 0.75g phiphones; and (d) purchased it.
F. Around 19:00 on May 9, 2013, the Defendant issued and received a one of the multiple strings vehicles of M parked in the front of the Defendant’s house located in Seosan City L, to M without compensation, and a one of the multiple strings that contain 0.03g philopon to M.
2. Medication of phiphones.
A. At around 23:00 on September 28, 2012, the Defendant administered 0.03g of philophones received from the Defendant’s house located in Western L, such as paragraph 1(a), once in water.
B. At around 20:00 on October 27, 2012, the Defendant administered 0.03g of philophones received, such as paragraph 1(b), once in the same place as the above paragraph (a).
