Reasons
Punishment of the crime
1. Defendants, D, E, F, G, H, and I’s co-principal offenders, D, E, E, F, G, H and I’s co-principal drivers, and H and I: (a) the Defendant was driven by the Defendant by the Jpoter test; (b) made the Defendant Company F, G, H and I win the vehicle on the Kpool test driven by the Defendant Company B; and (c) Defendant A conspired to receive insurance proceeds by intentionally causing a traffic accident that the Defendant Company was driven by the Defendant Company B with the said pool test.
On July 28, 2014, the Defendants, D, E, F, G, H, and I had intentionally caused an accident like the aforementioned public offering on the front of the so-called Yeongdeungpo-gu Seoul Metropolitan Government Handong Securities Road, and the Defendant A received an accident of modern marine fire insurance for the victims to whom he/she joined.
However, in fact, it was not a traffic accident that caused intentionally a traffic accident in order to receive insurance money.
Defendants, D, E, F, G, H and I, as such, deceiving the damaged insurance company, and they received KRW 790,000 from the damaged insurance company as agreed money on July 30, 2014, Defendant B received KRW 4,993,690 in total as shown in the separate crime list (3).
Accordingly, the Defendants, in collusion with D, E, F, G, H, and I, acquired 4,93,690 won.
2. The Defendants, G, E, L, and the Defendants, G, E, and L were to take the Defendant B, G, and E on the JNte car driven by Defendant A, and the Defendants conspired to receive insurance money by intentionally causing a traffic accident involving the said L with MR car.
Defendants, G, E, and L around August 20, 2014, around 04:33, the bus stops of the Ocultural Center located in Seocho-gu Seoul, Seocho-gu, Seoul, caused an intentional drilling accident, such as the above public offering, and L received an accident of malicious damage insurance for the victim to whom they joined.
However, it is difficult to say that it intentionally causes traffic accidents in order to receive insurance money.
