Reasons
Punishment of the crime
The Defendants conspired to have a person who intentionally caused a traffic accident or who is not at the scene of a traffic accident installed as a victim by referring to referring to referring to a person who is not at the scene of a traffic accident, and receive insurance proceeds under the name of agreement, etc. by reporting
1. On March 11, 2008, Defendant A, Defendant B, D, E, F, and G, together with H, conspired to intentionally cause a traffic accident and acquire insurance proceeds. On March 11, 2008, at around 23:40, Defendant A driven the Defendant B on the front of the Guro Digital Complex, Guro-gu Seoul, Guro-gu, Seoul, with I D, F, G, and H, caused a traffic accident by intentionally obtaining the back portion of the Jfin-gu car being driven by Defendant A while driving the Defendant B.
Since then, although the Defendants, etc. did not have a different nature from the above traffic accident, they were hospitalized in the K foreign medical clinic and L Hospital as if they were actually needed to be hospitalized, respectively. The victims Samsung Fire Insurance Co., Ltd. filed a claim for the payment of insurance proceeds with the victim Samsung Fire Insurance Co., Ltd., and received total of KRW 9,396,010 from March 12, 2008 to March 20, 2008 as shown in the annexed crime list 1, and acquired them by deception.
2. On October 26, 201, Defendant A, Defendant B, D, and M, who committed insurance fraud joint, intentionally induced a traffic accident and acquired insurance proceeds. On October 26, 201, around 20:47, Defendant A intentionally received and caused a traffic accident by intentionally taking the back portion of the NDap car driven by D on the front of the additional digital group in Geumcheon-gu Seoul Metropolitan Government Additional Digital Group.
Since then, although the defendants et al. did not have a different relation to the above traffic accident, they were hospitalized in K foreign medical institutions as if they were actually needed to be hospitalized, respectively, and they were paid insurance money to the victims Dong Fire Insurance Co., Ltd.
