피고인은 2017. 9. 15. 경 수원시 권선구 산업로 108에 있는 헥스파워시스템 주식회사 연구소에서 피해자 더 매스 웍스 인 코퍼 레이 티드 (The MAthWorks Inc.) 가 저작권을 가지고 있는 컴퓨터 프로그램 저작물인 ‘Matlab r2010b' 을 무단으로 복제하여 위 연구소에 있는 피고인이 사용하는 컴퓨터에 설치함으로써 피해자의 저작권을 침해하였다.
