Punishment of the crime

1. Defendant A, Defendant B, and Defendant C’s joint criminal conduct abuse of the lack of human resources at the construction site to recruit illegal aliens and supply them to a daily worker at the construction site. Defendant A conspired to take charge of fund management, Defendant B, and Defendant C to take charge of raising and managing illegal aliens.

When any person who violates the Immigration Control Act intends to employ a foreigner in the Republic of Korea, he/she shall employ a person who has obtained the sojourn qualification.

Nevertheless, from October 1, 2013 to February 26, 2014, the Defendants conspired to employ Chinese workers in E, F, G, and nameless in the construction industry who are not qualified for employment in the construction industry from around October 1, 2013 to around February 26, 2014 as a temporary worker at the construction site of Busan Shipping Daegu Urban Complex Corporation and the I Apartment-gu Busan Urban Complex Corporation.

(b) Any person who violates the Framework Act on the Construction Industry shall register the construction business with the Minister of Land, Infrastructure and Transport;

Nevertheless, on July 2013, the Defendants received a subcontract for the construction work at the construction site of the Busan Metropolitan Transportation Daegu H apartment, from the dong Construction (ju), a contractor at the construction site of the relevant apartment complex in Busan Metropolitan City, and received the payment of KRW 127,386,480 (K) in total four times from the contractor, from November 1, 2013 to February 22, 2014.

On August 2013, the Defendants continued to receive a re-subcontract for the construction project of the apartment house from the Gyeyang Construction Co., Ltd., a subcontractor for the I apartment complex construction project in Suwon-gu, Busan, to re-subcontract the construction project of the apartment house (the construction project of assembling and dismantling a concrete-type mold before and after the concrete typology). The Defendants made six instances from October 1, 2013 to February 26, 2014 to the subcontractor.
