Reasons
Punishment of the crime
The Defendant is a member of the Jung-gu Seoul Special Metropolitan City D&D Development Project Association from October 26, 2007 to December 2, 2007, who works as a member of the said Association’s Emergency Countermeasures Committee, and as the chairperson from May 8, 2010 to the E&C from May 8, 2010.
1. On June 10, 2010, the Defendant, at the Defendant’s house located in the Jung-gu Seoul Metropolitan Government F apartment 102 1802 Dong 1802, did not impose value-added tax on the housing unit below national housing size (85 m2) at the said association. However, the Defendant prepared a printed article stating that “No value-added tax shall be levied on the housing unit below the national housing size (85 m2)” as the title “0 m2 of the report,” and the title “No value-added tax shall be levied on the case where D&D redevelopment rearrangement project promoted by the D&D project is sold under the management and disposition plan, the executives of the association, using the fact that they are not aware of value-added tax, had them pay the value-added tax of KRW 4,539,00,000, in addition to the construction cost
