Reasons

Punishment of the crime

No person, other than the Seoul Olympic Sports Promotion Foundation or an entrusted business entity, shall provide property or property benefits to persons who correctly predicted the result by issuing sports betting tickets or similar things, or use them for gambling.

Nevertheless, on January 11, 2017, the Defendant joined the 'B', which is an illegal sports soil site, as a member, and transferred 3,000,000 won to the Agricultural Cooperative (F) account in the name of the Defendant’s wife C (D) and the Agricultural Cooperative account in the name of his/her father E (F) to the Agricultural Cooperative (F) account in the name of the said site, which is used for the deposit of the said site, and filled up the corresponding game money, and anticipated the outcome of various sports games, and attempted to sell the game money by betting, and to acquire dividends in accordance with the ratio of distribution if the money is lost or deficited, from that time to March 4, 2017, and then remitted the amount of KRW 57,050,000 to the said Agricultural Cooperative account in the name of the said Bank of Korea under the name of the said Agricultural Bank of Korea.
